Every photograph, video, description, and design on this site was created for The Spiritual Company. Copying them is theft, and we treat it that way.
1. What we own
All content published on thespiritualcompany.co is the exclusive property of The Spiritual Company or its licensors, and is protected under the United States Copyright Act (17 U.S.C. § 101 et seq.), the Lanham Act, international copyright treaties, and applicable trade dress and unfair competition law. This includes, without limitation:
- Photography — every product photograph, lifestyle image, model shot, flat-lay, and packaging image, including all edited, cropped, filtered, and derivative versions
- Video — all product videos, reels, unboxing footage, advertising creatives, and animations, including audio and voiceover
- Product design — the design, arrangement, bead composition, colorway, and styling of our bracelets and spiritual jewelry, together with our packaging, inserts, and presentation
- Written content — product titles and descriptions, mantras and intention copy, collection copy, blog articles, email and SMS copy, and these policies
- Brand assets — the name The Spiritual Company, our logo, wordmark, colors, typography, and overall look and feel of this store
2. What is not permitted
You may not, without our prior written permission:
- Copy, download, scrape, screenshot, mirror, or republish our photographs or videos on any website, marketplace, or social media account
- Use our images or videos to advertise, list, or sell any product — including on Shopify stores, Amazon, eBay, Etsy, Walmart, Temu, Alibaba, AliExpress, Meta and TikTok Shops, or any dropshipping catalogue
- Edit, crop, recolor, watermark over, mirror, or otherwise alter our content to disguise its origin
- Copy our product designs, packaging, or presentation in a way likely to confuse customers about who made the item
- Copy our written descriptions, collection copy, or policies, in whole or in substantial part
- Use our name, logo, or brand assets in listings, ads, storefronts, domain names, usernames, or metadata
- Use automated tools, bots, or scrapers to harvest content from this site
- Train, fine-tune, or build any machine learning or AI model on our images, videos, or written content
Adding a watermark, changing the background, flipping the image, or crediting us does not make unauthorized use lawful.
3. What we do about infringement
We actively monitor marketplaces, social platforms, and search results for unauthorized use of our content, including through automated image and video matching. Where we find it, we act. Depending on the case, that means one or more of the following:
- DMCA takedown notices to the infringing site, its host, its CDN, and its domain registrar under 17 U.S.C. § 512, and to Google for removal from search results
- Platform infringement reports to Shopify, Meta, TikTok, Instagram, YouTube, Amazon, Etsy, eBay, and any other marketplace involved, which can result in listing removal, store suspension, or permanent account termination
- Payment and advertising complaints to the infringing party's payment processor and ad networks
- A formal cease and desist letter from us or our attorneys, with a deadline for removal
- Civil legal proceedings for copyright infringement, trademark infringement, trade dress infringement, and unfair competition, seeking injunctive relief, damages, an account of the profits made from our content, and recovery of our legal costs where the law allows
We pursue infringement regardless of where the infringing party is located, and we do not accept ignorance, a supplier's assurance, or "the images were already online" as an excuse. Removing the content after we contact you does not by itself end liability for the period it was used.
4. Reporting infringement to us
If you have seen our photographs, videos, or designs being used by someone else, please tell us at thespiritualcompanyusa@gmail.com with the word "Infringement" in the subject line and a link or screenshot. We are grateful for every report.
5. If you believe we have infringed your rights
We respect other people's intellectual property and expect the same in return. If you believe content on this site infringes your copyright, send a written notice to thespiritualcompanyusa@gmail.com including:
- Identification of the copyrighted work you say has been infringed
- The URL or location of the material on our site
- Your name, address, telephone number, and email address
- A statement that you have a good faith belief the use is not authorized by the copyright owner, its agent, or the law
- A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf
- Your physical or electronic signature
We investigate every properly submitted notice and will remove or disable access to material that infringes.
6. Requesting permission
Affiliates, retailers, press, and creators are welcome to use our imagery — we just ask that you get permission first. Email thespiritualcompanyusa@gmail.com with "Permission Request" in the subject line, telling us which content you want to use and where it will appear. Permission, when granted, is given in writing and is limited to the use we approve.
7. Reservation of rights
Nothing on this site grants any licence or right to use our intellectual property. All rights not expressly granted are reserved. Our decision not to act on a particular infringement is not a waiver of our right to act on that or any other infringement later.
